Litigation

Our litigators have distinguished themselves in some of the most important cases to come before Canadian courts. Currently, we are representing the Government of Canada in multi-billion dollar claims by two Alberta First Nations. To date we have succeeded in having the claims on the first two phases dismissed, following a trial lasting more than four years. The case examines evidence in subjects as diverse as the application and impact of the made-in-Canada energy price policy of the 1970s and 1980s, as well as a number of issues relating to treaty rights, social programs and fiscal matters.

The scope of our litigation work is deep and comprehensive. We act in conjunction with our securities department on a regular basis, representing clients involved in transactional related disputes such as takeover bids. We represent oil and gas clients in disputes of all types and have an active aviation practice. We also defend members of professional groups, such as dentists, lawyers and architects, in negligence and disciplinary proceedings of all types.

Our litigators specialize in product liability cases and represent clients in appeals to the Canada Revenue Agency. We also represent clients in the arbitration of disputes arising under international commercial contracts that often involve the application of foreign law. In addition, members of our group have substantial expertise in dealing with cross-border and multi-jurisdictional disputes, including trial and appellate experience in both Canada and the United States.

Clients:
We represent clients ranging in size from large industrial corporations and financial institutions to start-up ventures and entrepreneurs. While many matters are resolved through representation and negotiation, members of our group represent client's interests before the courts when appropriate.

Our lawyers have appeared before the Court of Queen's Bench of Alberta, Alberta Court of Appeal, Ontario Superior Court of Justice, Ontario Court of Appeal, Federal Court, Federal Court of Appeal, the Tax Court of Canada, and the Supreme Court of Canada, as well as Superior Courts in other provinces. Our foreign offices have experience and expertise in dealing with the courts, administrative tribunals and arbitration panels in those jurisdictions.
