Macleod Dixon is Successful on the First-ever Challenge of an Electricity Market Rule Amendment in Ontario

Toronto, Ontario - April 11, 2007 - Acting on behalf of the Association of Power Producers of Ontario (APPrO) and individual electricity generators, the Macleod Dixon team was successful on the first-ever challenge of an Electricity Market Rule Amendment in Ontario. The Application was brought by the association of major power consumers and, had it been successful, it would have effectively stopped competition in the Ontario electricity market.

David Butters, President of APPrO, said, "while we cannot see yet what the future may bring as a result [of the victory], the 'APPrO team' did an outstanding job in preparing for, arguing and giving evidence in this frustrating but vitally important Proceeding.

Macleod Dixon's 'David vs. Goliath' team included Partners Elisabeth (Lisa) DeMarco and Robert Frank, and Associates Heather Landymore and Richard Oliver, of the Toronto office.

Landymore says that, "had the rule not been upheld, the financial impact on the Ontario generators would have been significant. Instead, generators may more accurately reflect the market."
