Ground-breaking Human Rights Case
Macleod Dixon represented the employer in a ground-breaking human rights matter involving pre-employment alcohol and drug testing that has potentially significant consequences for the energy and construction industries as well as other industries where safety is an important issue.
The Court of Appeal of Alberta ruled in favour of our client in December 2007 and it is expected that the Human Rights and Citizenship Commission will seek leave to appeal the decision to the Supreme Court of Canada.
CPR Signs Application and Development Support Agreements with Leading Global Outsourcing Firms
On August 2, 2007, Canadian Pacific Railway, announced two separate multi-year agreements with IBM and Infosys Technologies that will focus on the application development associated with management and maintenance of CPR's core operations. These agreements represent a significant corporate outsourcing initiative, which will provide considerable capability and quality enhancement. The outsourcing of the day-to-day mechanics of supporting and developing applications will mean that internal staff will become more of a strategic partner and focus on leveraging technology to provide direction and insights to the future.
Temporary Work Permits
Assisted the new Canadian subsidiary of a large international engineering procurement and construction company in obtaining necessary authorizations to obtain temporary work permits for more than 50 foreign engineers.
Multi-Party Hearing
Successfully represented a major Canadian employer in reaching a settlement in a multi-party complex hearing before the Canada Industrial Relations Board.
Wrongful Dismissal
Successfully prosecuted a wrongful dismissal claim against an international construction company on behalf of a senior manager wherein this Plaintiff received a significant award of damages as well as costs.
