Drafting a stepped/escalating clauseIt is now common for parties to incorporate a mechanism for mediation or other form of ADR in their contracts in an attempt to ensure a speedy and cost effective resolution of future disputes. Such clauses can be complex and if drafted incorrectly, can result in protracted litigation. This practical session aims to alert delegates of the pitfalls and provide drafting pointers and tips.
Expert determination - how to get the most from itThis form of dispute resolution is common in disputes where a valuation is required or where an expert opinion is needed on a technical matter. Perceived as providing a speedy resolution, caution must be exercised in drafting the expert determination clause otherwise the benefits are lost. This session will explain how the expert determination process works and provide drafting tips.
Introduction to MediationTraining to give delegates an insight into the mediation process, tips for how to handle negotiations in mediation and pointers to the types of disputes which lend themselves to resolution by mediation.
Mediation WorkshopThe aim of this 3 hour workshop is to re-create mediation with delegates assuming the roles of the various parties involved. This will give delegates an understanding of the mediation process and the tactics involved. Delegates will require a basic understanding of the mediation process.
Mediation demonstrationA one and a half hour seminar (or live workshop) during which delegates will gain an understanding of the mediation process by witnessing a mediation in progress. This is aimed at those with little or no knowledge of mediation.
Negotiation trainingThe negotiation tactics used in mediation differ to the standard positional bargaining stance taken in non-mediated negotiations. This one hour lecture or two hour workshop explains the difference in approach and how to ensure you are fully prepared for your mediation.
